Class Consent

Works receiving Ancient Monument Grant are covered under the Class Consent Order, and do not require a separate application for scheduled monument consent
Some types of works do not require scheduled monument consent as they are deemed to have consent, under the terms of the Ancient Monuments (Class Consents) (Scotland) Order 1996 (‘the Class Consents Order’). Works covered under class consent include:
  • Class I: Ploughing
Where ploughing has previously lawfully been undertaken in the preceding 10 years, providing the depth of ploughing does not exceed previous depths, scheduled monument consent is not required.  

It is important to note that most changes to an agricultural regime (for example, deeper ploughing, de-stoning, sub-soiling or drainage works) would need scheduled monument consent.

  • Class V Works which are urgently necessary in the interests of health or safety
Occasionally, there is a need to carry out urgent works in the interest of health and safety.  This may include the removal of loose masonry, felling of trees or other minor works where there is an immediate threat to the public.

These works are covered under Class V of the Class Consents Order, provided that the works are limited to the minimum measures immediately necessary.

Historic Scotland must be notified in writing of any works carried out under Class V.   A full description and justification of the works must be provided.  A notification form can be downloaded below.

  • Class VII Works executed under a management agreement with Historic Scotland
Historic Scotland can enter into a legal agreement to secure medium to long term management changes within a scheduled area.  Works carried out under these ‘management agreements’ are covered under class VII of the Class Consents Order.

  • Class VIII Works executed through the Ancient Monuments Grant programme
Historic Scotland, through the Ancient Monuments Grant Programme provides financial assistance to help preserve and maintain monuments, and in some cases to present them to the public.  Works undertaken through the Ancient Monuments Grant Programme are covered under Class VIII of the Class Consents Order.   

Please note that works funded under other Historic Scotland grants programmes, such as the Archaeology Grants, are not covered.  In these circumstances a separate application for scheduled monument consent is required.
