The Business and Regulatory Impact Assessment (BRIA) aims to provide information on the options considered in relation to the Historic Environment (Amendment) (Scotland) Bill and its regulatory impact across Scotland.

Current legislation

The Historic Environment (Amendment) Scotland Bill will be looking to amend some parts of current legislation in order to allow for a enhanced level of protection for the historic environment and provide an improved service to stakeholders by addressing the gaps and weaknesses identified during the stakeholder engagement process. There are three acts that could be directly effected, the Historic Buildings and Ancient Monuments Act 1953, The Ancient Monuments and Archaeological Areas Act 1979 and the Planning (listed Buildings and Conservation Areas)(Scotland) Act 1997. Copies of these acts can be accessed below along with their supporting and related documents.

The draft Bill was consulted on between 20 May and 14 August 2009.  The consultation document, which incorporated a copy of the draft Bill, can be viewed via the following link:

The Heritage Protection Bill for England and Wales

A draft Heritage Protection Bill for England and Wales was published in April 2008 and subject to pre-legislative scrutiny and public consultation over the summer.  However, the Bill was not included in the Queen’s speech last December and is not part of the Westminster Government’s legislative programme for 2009-10.  According to the Department for Culture, Media and Sport the Government remains committed to this legislation and it will be brought forward at a later date as soon as Parliamentary time allows.
