Environment Information (Scotland) Regulations 2004

Some information held by Historic Scotland is subject to the Environmental Information (Scotland) Regulations, which came into force in January 2005. These regulations complement the FoI Act but are more detailed and deal specifically with environmental information.

You can request environmental information in the same way as making a FoI request.

Most requests under these regulations will be free and can be dealt with in 20 working days. However, in exceptional circumstances, we are allowed to take up to 40 working days to respond.

Re-Use of Public Sector Information Regulations 2005

Provision of information in response to a request made under FoI does not mean that you may re-use that information.

The Re-use of Public Sector Information Regulations (PSI) 2005 are designed to make it easier to re-use information held by public bodies. For further information see the Office of Public Sector Information.

Data Protection

Under the Data Protection Act 1998 you have the right to ask us whether we process any personal information relating to you and if so to provide you with a copy of this information. This is called a subject access request.

To request your personal information from Historic Scotland you should write to the Data Protection Officer.

Your request should include a contact address and documented evidence of who you are (e.g. copies of your driving licence, passport or birth certificate).

You should provide as much detail as possible regarding the information you wish to access. We may come back to you for additional details in order to locate the material you require.
We will require payment of a fee of £10 from you before we start to search for your information.

We will aim to meet your request within 40 days of receiving from you all of the above information and payment of the £10 fee.
